Terms & Conditions

§ 1. General Provisions

  1. These Terms and Conditions set out the rules for using the website available at arduralab.com (hereinafter: the “Website”).
  2. The owner and operator of the Website is ARDURA Lab, with its registered office in Warsaw, ul. Ząbkowska 31, 03-736 Warsaw, Poland, tax identification number (NIP): PL1132052589 (hereinafter: the “Service Provider”).

  4. These Terms and Conditions constitute the terms of service within the meaning of the Polish Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws of 2020, item 344, as amended).
  5. Use of the Website constitutes acceptance of these Terms and Conditions.

§ 2. Definitions

  1. Website — the website available at arduralab.com, including all of its sub-pages.
  2. User — any natural person using the Website.
  3. Service Provider — ARDURA Lab, the entity operating the Website.
  4. Services — services provided electronically through the Website, in particular the provision of informational content.
  5. Agreement — a separate service agreement concluded between the Service Provider and the client, the terms of which are determined individually.

§ 3. Electronic Services

  1. Through the Website, the Service Provider provides the following electronic services free of charge:
    • informational content about the Service Provider’s services,
    • articles in the knowledge base (blog),
    • a glossary of SEO, GEO, and web development terms,
    • a portfolio of completed projects,
    • indicative pricing of services,
    • the ability to contact the Service Provider by email.
  2. Paid services (website development, SEO, GEO, advertising campaigns, digital strategy) are provided on the basis of separate agreements concluded individually with the client. The detailed scope, conditions, and prices of paid services are determined on a case-by-case basis through individual arrangements.
  3. The indicative prices of services presented on the Website are for informational purposes only and do not constitute an offer within the meaning of Art. 66 of the Polish Civil Code.

§ 4. Technical Requirements

To use the Website properly, the following is required:

  • a device with internet access,
  • a current version of a web browser (Chrome, Firefox, Safari, Edge),
  • JavaScript enabled.

§ 5. Rules of Use

  1. The User agrees to use the Website in accordance with its intended purpose, these Terms and Conditions, and applicable law.
  2. The following is prohibited:
    • taking actions that may disrupt the functioning of the Website,
    • using the Website’s content in a manner that infringes the Service Provider’s copyright,
    • automated downloading of the Website’s content (scraping) for commercial purposes without the prior consent of the Service Provider,
    • sending spam or unlawful content through the Service Provider’s contact details.

§ 6. Copyright and Intellectual Property

  1. All content published on the Website, including texts, graphics, logos, photographs, page layout, and source code, is the property of the Service Provider or is used under appropriate licences and is protected under the Polish Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 2022, item 2509, as amended).
  2. Copying, distributing, modifying, or otherwise using the Website’s content without the prior written consent of the Service Provider is prohibited, except for cases of fair use for personal purposes as permitted by applicable law.
  3. The Service Provider permits the indexing of the Website’s content by search engines and artificial intelligence systems, in accordance with the rules set out in the robots.txt file.

§ 7. Liability

  1. The Service Provider makes every effort to ensure that the content published on the Website is up to date, accurate, and complete. Informational content (articles, glossary, blog) is educational in nature and does not constitute professional advice.
  2. The Service Provider is not liable for:
    • temporary unavailability of the Website due to maintenance work, server failure, or force majeure,
    • decisions made by the User on the basis of educational content published on the Website,
    • the content of external websites to which links on the Website may direct.
  3. The Service Provider’s liability for paid services is governed by the separate agreement concluded with the client.

§ 8. Complaints

  1. Complaints regarding the functioning of the Website or services provided electronically may be submitted by email to: [email protected].
  2. A complaint should include: the name or company name, email address, a description of the issue, and the expected resolution.
  3. The Service Provider will process complaints within 14 days of receipt and will notify the complainant of the outcome by email.

§ 9. Data Protection

The rules for processing Users’ personal data are set out in the Privacy Policy, which forms an integral part of these Terms and Conditions.

§ 10. Changes to Terms and Conditions

  1. The Service Provider reserves the right to amend these Terms and Conditions for important reasons, in particular in the event of changes in legislation, changes in the scope of services provided, or technical changes to the Website.
  2. The Service Provider will notify Users of any changes by publishing the updated Terms and Conditions on the Website together with the date of the last update.
  3. Continued use of the Website after changes have been made constitutes acceptance of the updated Terms and Conditions.

§ 11. Final Provisions

  1. Matters not regulated by these Terms and Conditions shall be governed by the provisions of Polish law, in particular the Civil Code and the Act on the Provision of Electronic Services.
  2. Any disputes arising from the use of the Website shall be resolved by the court having jurisdiction over the Service Provider’s registered office, unless specific provisions provide otherwise (in the case of consumers, the court having jurisdiction under general provisions shall apply).
  3. These Terms and Conditions enter into force on the date of publication on the Website.
